TAUPŌ GO KARTS
TERMS & CONDITIONS
1. DUTY OF CARE
Go-karting is a physical recreational activity that involves inherent risks, including the risk of injury, collision, loss of control and changing track or weather conditions.
Taupō Go Karts takes reasonable steps to manage these risks through safety procedures, staff and marshal supervision, equipment maintenance and track controls. However, the risks associated with participation cannot be completely eliminated.
2. PARTICIPATION AT YOUR OWN RISK
Participants should consider their own driving ability and physical condition before participating.
By participating, participants acknowledge that they are taking part in an activity involving powered go-karts and accept the inherent risks associated with participation, subject to their rights under applicable New Zealand law.
Participants are responsible for:
- Following all safety requirements.
- Following instructions given by staff and marshals.
- Driving within their own ability.
- Using all equipment correctly.
- Informing staff of any relevant concern that may affect their ability to participate safely.
Taupō Go Karts reserves the right to refuse or stop participation where a participant does not meet safety requirements or where their behaviour creates a safety risk to themselves or others.
3. PARTICIPATION REQUIREMENTS
All participants must meet the applicable age, height and weight requirements before participating.
Single Kart:
- Minimum age: 10 years
- Minimum height: 140 cm
Tandem Kart – Driver:
- Minimum age: 16 years
- Minimum height: 140 cm
Tandem Kart – Passenger:
- Minimum age: 6 years
- Minimum height: 120 cm
Maximum Weight:
- Maximum participant weight: 120 kg
Participants who do not meet the applicable participation requirements will not be permitted to race.
4. SAFETY BRIEFING
All drivers must attend and complete the compulsory safety briefing before participating.
Any driver who does not attend the required safety briefing will not be permitted onto the track until another briefing can be arranged.
5. CLOTHING AND SAFETY EQUIPMENT
Participants must wear suitable clothing and equipment for go-karting.
Participants must:
- Wear enclosed, toe-covering footwear.
- Secure long hair.
- Remove loose clothing, jewellery or other items that could interfere with the kart or safety equipment.
- Wear the required safety helmet correctly and securely.
Participants may use their own full-face helmet where it is appropriately NZ safety-accredited and suitable for the activity.
Participants who do not comply with clothing or safety-equipment requirements may be refused participation or have their race stopped.
6. ALCOHOL, DRUGS AND IMPAIRMENT
Taupō Go Karts operates a strict no-alcohol or drugs policy.
A person who is affected, or reasonably suspected of being affected, by alcohol or drugs will not be permitted to operate a go-kart.
Where required for safety purposes, staff may conduct an alcohol breath test in accordance with the Taupō Go Karts Alcohol Check Procedure.
A participant who refuses a required safety check may be refused permission to participate with no refund issued.
7. WEATHER AND TRACK CONDITIONS
Taupō Go Karts operates outdoors, and weather and track conditions can change throughout the day.
Racing may be delayed, suspended or cancelled where conditions create an unacceptable safety risk, including:
- Heavy or persistent rain.
- Standing or pooling water.
- Reduced visibility.
- Flooding.
- Lightning or severe weather.
- Conditions affecting safe braking, steering or kart control.
- Any other weather or track condition considered unsafe by Taupō Go Karts staff.
The decision to stop or suspend racing is a safety decision.
8. STAFF AND MARSHAL AUTHORITY
Staff and marshals have the authority to control, delay, interrupt or stop racing where required for safety.
Participants must comply with all reasonable instructions given by staff and marshals.
A race may be stopped, or a participant may be prevented from continuing, where:
- A safety requirement has not been met.
- Unsafe driving or behaviour occurs.
- Track or weather conditions become unsafe.
- A kart or piece of equipment presents a safety concern.
- An incident or emergency occurs.
- Staff determine that continuing would create an unacceptable safety risk.
Staff safety decisions are final.
Taupō Go Karts will prioritise the safety of participants, staff and other persons over participant convenience, race times or continuation of an activity.
9. WET WEATHER, CANCELLATION AND REFUND PROCEDURE
If Taupō Go Karts cancels due to weather, or determines that racing cannot safely proceed, the affected participant may choose, where applicable, to:
- Rebook: Transfer the booking to another available date or time.
- Wait: If there is a reasonable possibility that conditions will improve, participants may choose to wait.
- Request a refund: Where the activity cannot be provided and the participant does not wish to rebook; the applicable refund will be considered subject to New Zealand consumer law.
10. PARTICIPANT CANCELLATION AND BOOKING CHANGES
Participant cancellations and booking changes are separate from cancellations made by Taupō Go Karts due to weather or safety conditions.
More than 24 hours before the booking:
Participants may request to cancel or change their booking, provided the request is made more than 24 hours before the booking date.
Changes are subject to availability and the applicable booking terms.
Within 24 hours of the booking:
Late cancellations or booking changes may be subject to the applicable cancellation terms.
Rescheduling within 24 hours may be considered at the discretion of Taupō Motorsport Park.
No refunds will normally be provided for cancellations made within 24 hours, subject to any rights available under applicable New Zealand law.
No-show:
If a participant does not attend their booking and has not contacted Taupō Go Karts, the booking may be treated as a no-show in accordance with the applicable booking terms.
11. PARTICIPANT BEHAVIOUR
Participants are expected to behave respectfully and follow reasonable directions while on Taupō Motorsport Park premises.
Taupō Go Karts reserves the right to refuse service, stop participation or require a person to leave the premises where their behaviour presents a safety, security or operational concern.
Participants must not interfere with safety equipment, track infrastructure, karts or other operational equipment.
Participants may be responsible for damage to Taupō Motorsport Park property or equipment caused deliberately, recklessly or negligently, subject to applicable New Zealand law.
12. PERSONAL BELONGINGS
Participants are responsible for their personal belongings while at Taupō Motorsport Park.
Taupō Motorsport Park is not responsible for loss of or damage to personal belongings except where liability cannot legally be excluded.
Participants should take reasonable care of their belongings and follow any instructions provided by staff regarding where items may be stored during participation.
13. INCIDENTS AND NEAR MISSES
Any participant who is involved in, witnesses or experiences an incident, accident or near miss must report it to a Taupō Go Karts staff member as soon as possible.
Reporting incidents and near misses helps Taupō Motorsport Park identify hazards and maintain the safety of participants, staff and other persons at the venue.
14. PRICING AND PAYMENT
All prices are in New Zealand Dollars unless otherwise stated.
Prices, promotions and booking conditions may vary and are subject to the applicable offer or booking terms.
15. CONSUMER GUARANTEES ACT AND NEW ZEALAND LAW
Nothing in these Terms & Conditions limits or excludes any rights or remedies that cannot legally be excluded under New Zealand law.
This includes rights and remedies available under the Consumer Guarantees Act 1993, the Fair-Trading Act 1986 and any other applicable legislation.
Where Taupō Go Karts cannot provide a booked service, or where another statutory remedy applies, the appropriate remedy will be considered in accordance with the circumstances and applicable law.
16. CHANGES TO THESE TERMS & CONDITIONS
Taupō Motorsport Park reserves the right to make reasonable changes to these Terms & Conditions, policies and procedures.
17. KEY SAFETY PRINCIPLE
IF IT IS NOT SAFE, WE DO NOT RUN IT.
Taupō Go Karts will always prioritise the safety of participants, staff and other persons over participant convenience, race times or continuation of an activity.
